Assets of Community Value

‌‌‌What is this?

This new Community Right (sometimes called the “Community Right to Buy” or “Community Right to Bid”) allows defined community groups, to ask the Council to list certain assets as being of “community value”. This is designed to give communities more opportunities to take control of the assets and facilities important to them. If an asset is listed and then comes up for sale,  the new right will give communities that want it a total of 6 months to put together a bid to buy it (including a 6-week cut-off for an initial proposal to be put forward).

Who can nominate?

The following organisations are eligible to nominate assets.

  • Parish Councils.
  • Neighbouring Parish Councils.
  • Unincorporated groups.
  • Neighbourhood forums.
  • Community interest groups with a local connection.

How to make a Community Nomination

A decision will be made within 8 weeks of the receipt of a completed nomination form on whether to list the asset. The asset will then be placed on a list of successful and unsuccessful nominations on the Council’s website.

If you are interested in pursuing the nomination of an asset, please apply in writing to the Council’s Chief Executive.

 Notice of Intention to Dispose of Asset of Community Value

On 23 May 2017  Rushcliffe Borough Council received notification pursuant to s.95(2) Localism Act 2011 that the property owners of Royal British Legion,

15 Nottingham Road, Gotham intend to enter into a relevant disposal of the property.

The initial moratorium period will end on 4 July 2017, prior to which eligible community bodies have the opportunity to submit an expression of interest to purchase the property. Manor House - Bingham

The decision is that the Manor House, Bingham should not be included in the list. The reason for this decision is that the building does not meet the criteria for inclusion in the list as specified in section 88 of the Localism Act 2011. The building does not have a current community use and neither has it had one in the recent past. In terms of this latter criterion, the previous use as an antique shop is not a use which “furthered the social wellbeing or interests of the local community” as defined in the legislation.  In any event, such use was not “in the recent past” having regard to the fact that it was over 12 years ago.

Further there is no evidence to indicate that “it is realistic to think that there is a time in the next five years when there could be non-ancillary use …that would further the social wellbeing or social interest of the local community.

Park Lodge - West Bridgford

To qualify for inclusion in the list of Assets of Community Value there must be an "actual current use of the building…(that) furthers the social wellbeing or social interests of the local community" or there must have been a time "in the recent past" when actual use of the building did so (section 88 of the Localism Act 2011 (1)(a) and (2)(a). No evidence has been submitted as to the manner in which the occupation by the current users has furthered the social wellbeing or social interests of the local community. It is not considered that use prior to 2011 by Rushcliffe CVS constitutes "recent past". Furthermore use by RVCS was principally as an adminstrative office with occasional visits by prospective volunteers.

Stanford Hall

Stanford Hall does not meet the criteria for inclusion in the statutory list of assets of community value. Section 88 of the Localism Act 2011 provides that any qualifying use of the land or building must not be an ancillary use. The evidence that I have considered in respect of this application indicates that, to the extent that the historic use described in the application might otherwise be a qualifying community use, the use of the theatre has in fact at all times been ancillary to the primary use of Stanford Hall. It also appears likely that any future such use would remain ancillary. I have also noted that the application for nomination, in section A5 states that the use of Stanford Hall Theatre by performing societies and clubs ceased in 2004/05.I do not consider that a period of over 9 years represents “the recent past“, for the purposes of section 88(2)(a) in the context of this application.

The nomination by Tollerton Parish Council was properly made, the land is not an excluded category under the Regulations, and the current use of the land is considered to meet the statutory criteria for an asset of community value as it furthers the social well-being or social interests of the local community. However, it has been determined that it is not realistic to think that the site could continue to further the social well-being or interests of the community because the land is occupied under a lease that can be terminated on 6 months’ notice and the owners have indicated that the land may be required in connection with proposed improvements to the A52.

Having considered the nomination for the Plough public house at Wysall to be listed as an asset of community value under Part 5 of the Localism Act 2011 it has been concluded that there is insufficient evidence that ‘The Friends of Wysall Pubs’ exists as an unincorporated body for the purposes of the Act and the relevant Regulations.
