Response

I can confirm that there are no known cases where a developer has yet to fulfil a S106 obligation to transfer open space to the Borough Council and pay a commuted sum. It has been a number of years since the Council have agreed to adopt open space land, with S106 agreements now generally requiring open spaces to be maintained by the owner or an appointed management company, in line with an approved Open Space Scheme. The last transfer of open space to the Council with payment of a commuted sum took place in December of 2021.
