- There is one instance of the Borough Council having been required to return developer contributions. A sum of £51,400 was secured through a Section 106 legal agreement from the development of The Point (app ref 07/00829/FUL), for the purposes of funding integrated transport measures.
The Highways Authority subsequently did not apply for commitment of these funds within the timescale allowed. The Borough Council was the developer for The Point, and so we were required to repay the contribution to ourselves. The funds were subsequently spent to deliver a pedestrian and cycle access, which would have been a valid use of the funds under the original planning agreement.
